An Alabama woman has been charged with capital murder in a deadly domestic shooting earlier this week in Birmingham.
The Jefferson County District Attorney’s Office issued the warrant against 24-year-old Tykirel Jordan in the slaying of 32-year-old Alpatrick McKinstry. According to Birmingham police, the charge is a capital offense because the killing happened in the presence of multiple children, including at least one shared by the couple.
Just after 7 p.m. Monday, West Precinct officers were dispatched to the 1300 block of 60th Street Ensley on a call of a person shot, said Birmingham police spokesman Officer Truman Fitzgerald.
The caller said a male was shot by a female, who left the scene, Fitzgerald said.
Officers arrived on the scene to find McKinstry unresponsive in the front yard of a home. Birmingham Fire and Rescue Service pronounced him dead on the scene.
A short time later, a female now identified as Jordan called from Fairfield saying she shot the victim at the Ensley scene. Birmingham officers went to Fairfield and took the woman into custody.
Police said they believed the woman and the victim had a romantic relationship and that an argument preceded the shooting.
Under Alabama law, a person can be charged with capital murder if the killing happened in the presence of a child under the age of 14 at the time of the offense if the victim was the parent or legal guardian of the child. “In the presence of a child” means in the physical presence of a child or having knowledge that a child is present and may see or hear the act, according to the law.
Jordan will be held without bond in the Jefferson County Jail.
