A Maryland man was sentenced to serve 45 years in prison for killing a man at Burger King in Frederick last year.
21-year-old Darin Tyler Robey was found guilty in August of second-degree murder and weapons violations.
Police said on December 26, 2021, Robey went to the Burger King restaurant to confront his then-girlfriend. Witnesses tried to intervene.
When 21-year-old Jaion Penamon asked Robey to take the argument outside, Robey shot him twice in the chest.
Penamon was pronounced dead at the scene.
“The most egregious second-degree murders deserve the harshest sentences. Robey lacked remorse from the second he pulled the trigger, to when he stepped over Jaion’s dying body and casually walked away, until today,” Frederick County State’s Attorney Charlie Smith.
Prosecutors said the sentencing hearing was delayed after a fight broke out between the families of Penamon and Robey. The courthouse was placed on lockdown but the hearing resumed about an hour later.
